Government states why woman needs hubby’s NOC for name change | India News

NEW DELHI: Government Monday told Rajya Sabha that a clarification issued with regard to the gazette notification for name change mandating a married woman to get an NOC from her husband to revert to her maiden surname was aimed at avoiding any legal issues.
Govt’s response is important since in March this year, a woman had filed a petition in Delhi high court, challenging the government notification.The court had sought a response from Centre and is scheduled to hear the matter on Aug 7.
In a reply to a question from TMC MP Saket Gokhale, MoS Tokhan Sahu submitted that clarifications, including requirements for reverting to maiden surname, have been issued from time to time. “Change in name involves a change in identity of a person, requiring close scrutiny to minimise or avoid any possible misuse or litigation and to maintain the sanctity of gazette notifications. Minimum essential requirements have, therefore, been kept for processing the change of name applications,” Sahu replied.
