PRAYAGRAJ: llahabad high court has come to the rescue of three siblings from a Muslim family, who were expelled from a private school in Amroha district for allegedly bringing non-vegetarian food in their tiffin box, reports Rajesh Kumar Pandey.
Hearing a writ petition filed by a woman and her three children, a division bench of Justice Siddhartha and Justice Subhash Chandra Sharma, in the order dated Dec 17, directed Amroha district magistrate to ensure the three children are admitted to another CBSE-affiliated school within two weeks, and file an affidavit. Failure to comply will require the DM to be present before the court on the next date of hearing on Jan 6, the court directed.
According to the petition, the three siblings were expelled by the principal of a private school in Sept 2024 for bringing non-vegetarian food in tiffin box. The petitioners claimed that their right to education had been affected by the conduct of the school.
They said that the incident had a scarring effect on the delicate psyche of the children and would have lifelong consequences irrespective of how the future plays out.
The plea added that the discriminatory conduct of the school administration had violated the rights of petitioners under Article 17 of the Constitution, with Sections 5 and 6 of the Protection of Civil Rights Act, 1955.
