NEW DELHI: The Supreme Court has granted anticipatory bail to two children of suspended Delhi government official Premoday Khakha, who along with his wife, were arrested for allegedly repeatedly raping a 17-year-old girl in his care at his residence between 2020 and 2021. The couple’s son and daughter have been implicated in the case for abetting sexual abuse by not reporting the incident and remained silent.
A bench of Justices C T Ravikumar and Rajesh Bindal granted them relief, noting that the main offences are alleged against their father and they have also joined the investigation in the case.The children, who are college going students, moved the apex court after their plea for pre-arrest bail was rejected by Delhi High Court.
Appearing for the petitioners, senior advocate Siddharth Luthra submitted that they had not committed any offence and had been unjustly implicated due to ulterior motive and malice and keeping them in custody would not serve any purpose. Referring to various judgments of the apex court, he said that the apex court in a catena of judgements held that subjecting young persons in the company of hardened criminals would do more harm than good to them.
Agreeing with Luthra’s submission, the bench granted them relief.
