JAIPUR: Rajasthan high court on Tuesday stayed coercive action till May 27 against a judicial magistrate in Karauli district who has been booked for allegedly asking a rape survivor to strip and show her injuries. HC also asked the media not to “sensationalise” the issue.
A single bench of Justice Anil Kumar Upman issued notices to state govt, Union I&B ministry, state chief secretary, DGP and a private news channel among others on a petition filed by the Rajasthan Judicial Service Officers Association.The plea seeks quashing of the FIR on the grounds that no permission was taken from the HC chief justice, nor was any preliminary inquiry conducted by police, before filing the case.
“Supreme Court, in an order on March 7, 1994, held that no crime investigation shall be registered against a judicial officer without the permission of the chief justice of the HC,” the petition mentioned.
