NEW DELHI: Delhi high court judge Amit Sharma on Thursday recused himself from hearing a plea by NIA seeking death penalty for separatist Yasin Malik in a terror funding case.
The matter was listed before a division bench headed by Justice Prathiba Singh after a change in roster of judges dealing with such cases.
The J&K Liberation Front chief, who is currently serving a life term in the case, was virtually present from Tihar.
On May 24, 2022, a trial court sentenced Malik to life imprisonment after holding him guilty for offences under UAPA. Malik had pleaded guilty to the charges and was convicted and sentenced to life term. Appealing against the sentence, NIA emphasised that a terrorist cannot be sentenced life term only because he has pleaded guilty and chosen not to go through trial.
